Are you certain that your opponent is in check after you have made a move?
Or is it your opponent is currently not under check after your move but will run into check after his/her next move?
There is a big difference between the two scenarios.
In the game which Martin has posted, the Black king is not under check after White's 58. Re8, but will run into check if Black makes his/her 58th move. The Black king cannot move legally but is not currently under check and there are no other legal moves available for Black. This is stalemate, which is ruled as a draw by the rules of chess.
