Not true. The problem statement is "White TO MOVE and not mate Black". If you don't make a move, then you haven't followed the instructions.
Actually, Fabel’s original stipulation reads “Nicht Matt in einem Zug!” (“Not mate in one move!”), so Frankdawg’s solutions do satisfy the stipulation.
More simply, in composition chess players and arbiters are considered muted. Even transactions which commonly require interaction are automated like triple repetition and 50-moves without capture or pawn move. They are just declared draws without ever raising a voice to claim anything. Also compositions have no clock flags to contend with. Without means to push a brake you gotta play a move!
